These Terms and Conditions govern applications for, access to and use of JoinHeyBella.com and the related Hey Bella dating, profile, matching, messaging, verification, payment, safety and support services.
1. About Hey Bella and these Terms

In these Terms:
- “Hey Bella,” “we,” “us” and “our” mean Hey Bella Group.
- “Service” means JoinHeyBella.com, the Hey Bella progressive web application and related services, features and communications.
- “Applicant” means a person who submits or begins an application.
- “Member” means an approved applicant whose membership has been activated.
- “Content” means photographs, profile information, messages, responses, feedback and other material submitted through the Service.
- “Founder Offer Member” means one of the first 500 eligible approved members who completes the required verification and successfully pays the Founder Offer membership price described in these Terms.
2. Acceptance of these Terms
By submitting an application, creating or activating an account, purchasing a membership, or using the Service, you agree to these Terms.
You must also read our Privacy Policy. Acknowledging the Privacy Policy does not replace any separate consent required by law for sensitive personal information or another specific processing activity.
If you do not agree to these Terms, you must not apply for, purchase or use the Service.
3. Eligibility
You may apply for Hey Bella only if you:
- are at least 18 years old;
- are legally capable of entering into a binding contract;
- submit an application for yourself;
- provide information that is accurate, current and complete;
- satisfy any location requirements displayed during application; and
- have not been permanently banned from Hey Bella unless we expressly permit you to reapply.
The Service is currently designed primarily for people living in Australia. We may restrict applications or access from jurisdictions where the Service is not offered or where additional legal requirements have not yet been implemented.
You must not:
- create an account for another person;
- maintain more than one account without our written permission;
- transfer, sell or give your account to another person; or
- allow another person to use your account.
4. Application and manual review
Hey Bella is an application-only dating service. Submitting an application does not guarantee approval, membership, a match, an introduction, a message, a date or any particular relationship outcome.
Applications are reviewed by authorised Hey Bella personnel. We may:
- approve an application;
- place an application on a waitlist;
- request further information or clarification;
- decline an application; or
- close an incomplete, abandoned or fraudulent application.
We may reasonably consider matters including:
- completeness and apparent authenticity;
- age and location eligibility;
- completion of required verification;
- safety, fraud or impersonation concerns;
- previous breaches, bans or attempted duplicate accounts;
- whether the applicant appears to intend to use the Service appropriately; and
- Service capacity.
We will not make application decisions on unlawfully discriminatory grounds.
Where appropriate, we may provide a general reason for a decision. We may withhold detailed reasons where disclosure could compromise another person’s privacy or safety, reveal security or fraud controls, expose confidential reporting information, or prejudice an investigation.
No membership payment is due merely for submitting an application. Payment is requested only after acceptance unless the checkout page expressly states otherwise. If Hey Bella receives a membership payment before approval and later declines the application, the payment will be refunded in full.
5. Account activation and security
Approved applicants must complete the required activation, payment and verification steps before membership becomes active.
You are responsible for:
- maintaining access to your registered email account;
- protecting login links, verification codes and account access methods;
- keeping your profile and account details accurate;
- notifying us promptly of suspected unauthorised access; and
- ensuring that nobody else uses your account.
We may require reverification where we reasonably identify suspicious activity, a material profile change, a possible duplicate account, a possible impersonation attempt or another legitimate safety concern.
6. Nature of the Service
Hey Bella provides a platform intended to help approved adult members discover and communicate with potential matches.
Matching means Hey Bella’s profile discovery and recommendation service; it does not guarantee any particular number of matches.
Depending on features available at the relevant time, the Service may allow members to:
- create and maintain a dating profile;
- upload approved profile photographs;
- receive, view or discover profiles;
- indicate interest;
- receive matches or introductions;
- exchange direct text messages with matches;
- block or unmatch another member;
- report members or Content; and
- manage membership and account settings.
Hey Bella does not guarantee:
- a minimum number of members, profiles, matches, messages or introductions;
- that another member will respond;
- compatibility or attraction;
- an in-person meeting;
- the accuracy of every statement made by another member;
- friendship, dating, a relationship, partnership or marriage; or
- any other particular personal or commercial outcome.
A lack of matches, messages, dates or relationship success does not by itself mean that the Service is defective.
7. Selfie verification and verification images
Hey Bella may require selfie verification before membership is activated or a profile becomes visible.
The verification technology is proprietary Hey Bella software. At the date of these Terms, the verification process is designed to:
- confirm liveness through simple on-screen movement instructions, such as turning your head left or right;
- capture a verification image; and
- allow authorised Hey Bella personnel to manually compare the verification image with submitted profile photographs for authenticity and impersonation prevention.
Hey Bella does not use the verification image to create or store a faceprint, facial-geometry template, facial embedding, reusable biometric template or other biometric identifier for automated identification. The comparison with profile photographs is performed manually by authorised personnel.
The software may process visual information in real time as necessary to confirm liveness or completion of movement instructions, but it is not designed to uniquely identify a person through a stored biometric template.
Verification images are handled and deleted in accordance with the Privacy Policy and are not displayed to other members.
Hey Bella does not currently require government identification as part of the standard verification process and does not conduct criminal-record, employment, credit or financial background checks as part of ordinary membership approval.
A successful verification does not guarantee a member’s legal identity, age, history, honesty, intentions, relationship status or safety.
If Hey Bella later introduces technology that creates or uses biometric identifiers, we will provide any additional notice and obtain any consent required by applicable law before that processing begins.
8. Profile photographs and profile information
Profile photographs may be manually reviewed before approval. We may reject, remove or require replacement of photographs or profile Content that:
- is misleading, fraudulent or materially altered in a deceptive way;
- does not clearly represent the member;
- shows another person without appropriate permission;
- contains nudity or sexually explicit material;
- includes private contact details where prohibited by our safety rules;
- promotes a business or commercial service without permission;
- infringes another person’s rights;
- creates a safety or privacy concern; or
- otherwise breaches these Terms or our published community standards.
Photo approval means only that the photograph passed the review applied at that time. It is not an identity guarantee, endorsement, background check or safety certification.
Your exact date of birth, private email address, verification image and payment-card details are not displayed to other members.
9. Founder Offer — first 500 members
9.1 Founder Offer price
The first 500 eligible approved members who complete all required verification and successfully complete their first membership payment are eligible for the Founder Offer price for their applicable country or market for their first 12 months of membership.
Founder Offer pricing is country-specific and charged in the currency displayed to the member at checkout. Current Founder Offer prices may include:
- Australia — AUD $99
- United States — USD $99
- United Kingdom — GBP £99
- Canada — CAD $99
- Supported European markets using the euro — EUR €99
These are separate local-market prices and are not currency conversions of the Australian price. The applicable price and currency will be clearly displayed before payment.
The Founder Offer:
- is limited to the first 500 qualifying members;
- is available once per person;
- is not transferable;
- is not available to duplicate or replacement accounts created to obtain the offer; and
- applies to the first 12-month membership term only unless Hey Bella expressly states otherwise in writing.
Eligibility is determined by the order in which qualifying approved members successfully complete payment, not merely by the time an application is started or submitted.
9.2 Services included in the Founder Offer
During the paid membership term, the Founder Offer includes access to the core Service then available to the member, including:
- Hey Bella matching and discovery services; and
- direct text messaging with matches.
The Founder Offer does not currently include:
- picture or image sharing within direct messages;
- voice calls;
- video calls;
- voice messages or voice memos; or
- another premium communication feature expressly identified as an additional paid feature.
9.3 Priority access to future communication features
If Hey Bella introduces picture sharing, voice calls, voice messages, voice memos or similar premium communication features, Founder Offer Members will receive priority for rollout or testing opportunities before or during broader release where reasonably practicable.
Priority access does not mean that a future feature is included in the Founder Offer membership price. Such features may be optional paid add-ons. The price, functionality, eligibility and release conditions for each future feature will be determined and disclosed before a member is charged.
We do not guarantee a particular release date, device compatibility, permanent availability or successful public launch of a feature that is still being tested.
10. Standard Membership Price
The standard membership price following the Founder Offer has not yet been determined.
Hey Bella may set or adjust future membership pricing from time to time having regard to factors including membership demand, Service usage, operating costs, market conditions, available features and the ongoing development of the Service.
Hey Bella reserves the right to increase or otherwise change membership pricing at its discretion. Any new or increased price will apply only to future purchases or renewal periods and will be clearly disclosed before the relevant payment is charged.
Prices will be displayed in the currency applicable to the member’s country or market, as shown at checkout. The applicable price, currency and any mandatory taxes or charges will be clearly disclosed before payment.
11. Automatic renewal and pricing changes
Unless your checkout states that a membership is non-renewing, paid annual membership automatically renews for successive 12-month periods until cancelled.
By completing checkout for an automatically renewing membership, you authorise Hey Bella and its payment processor to charge your selected payment method for the initial payment and each renewal at the price disclosed for that renewal.
Founder Offer Members will ordinarily renew after their first 12 months at Hey Bella’s then-current standard annual membership price, unless a different renewal offer is expressly provided.
Hey Bella reserves the right to change membership, feature and add-on pricing at any time. A price change will not retrospectively increase the price of a prepaid membership term that has already begun. Price changes may apply to future purchases, new memberships, add-ons or future renewal periods.
For an automatic annual renewal, we will provide reasonable advance notice of the renewal and any material price increase, including the upcoming renewal amount and a method to cancel before the renewal charge. We currently aim to send annual renewal reminders approximately 30 days before renewal.
If you do not agree with a future price, you may cancel before the relevant purchase or renewal without a cancellation penalty.
We will not charge a new optional paid feature merely because you qualify for priority testing or rollout. A separate charge requires clear disclosure and your authorisation.
12. Payments
Payments may be processed by Stripe or another payment processor disclosed at checkout.
By providing payment details, you authorise the payment processor to process the transaction and carry out reasonable fraud, security and legal-compliance checks.
Hey Bella may receive transaction information such as amount, status, transaction identifier, card brand and limited card information, but does not intend to store complete payment-card numbers or card security codes.
If payment fails, we may reasonably:
- ask you to update your payment method;
- retry a payment where permitted and previously authorised;
- temporarily restrict paid features; or
- cancel an unpaid membership after reasonable notice.
We will not impose an undisclosed late fee or penalty.
13. Cancelling membership
You may cancel future renewal at any time:
- through any account cancellation function made available in the Service; or
- by emailing support@joinheybella.com with Cancellation in the subject line.
There is no cancellation fee.
A cancellation request received before the renewal charge is effective even if we process the request later. If we charge a renewal after receiving a timely cancellation request, we will reverse the incorrect charge.
Unless you request immediate account closure, cancellation ordinarily:
- stops the next renewal;
- allows the current paid membership to remain active until the end of the paid term; and
- prevents further renewal charges.
Deleting your account will also cancel future membership renewal.
14. Refunds and Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.
Where the Australian Consumer Law applies, services supplied to consumers must comply with applicable consumer guarantees, including guarantees relating to due care and skill, fitness for a disclosed purpose and supply within a reasonable time where relevant.
Subject to non-excludable rights:
- we do not ordinarily provide a refund solely because you change your mind;
- cancellation normally stops future renewal rather than ending the current paid term;
- no refund is ordinarily due solely because you receive few or no matches, messages or dates;
- if we incorrectly or repeatedly charge you, we will refund the incorrect amount;
- if a payment is taken before approval and the application is declined, the payment will be refunded in full;
- if we permanently discontinue the core paid Service during a prepaid term, we will provide an appropriate remedy, which may include a reasonable pro-rata refund; and
- if we terminate a membership without member breach, we will ordinarily provide an appropriate pro-rata refund for the unused prepaid period, subject to applicable law.
Refund requests may be sent to support@joinheybella.com with Refund in the subject line.
Approved refunds will ordinarily be returned to the original payment method.
15. Member Content and licence
You retain ownership of original Content you submit to the Service.
You grant Hey Bella a non-exclusive, worldwide, royalty-free licence to host, store, copy, resize, format, transmit, display and moderate your Content only to the extent reasonably necessary to:
- operate and provide the Service;
- display your profile to permitted members;
- deliver messages and communications;
- maintain security and prevent fraud;
- investigate reports and enforce these Terms; and
- comply with legal obligations.
This licence ends when the relevant Content is deleted, except to the limited extent that a copy must remain temporarily in backups, safety records, legal records or another member’s existing message history, as permitted by law and described in the Privacy Policy.
We will not use your profile photograph or testimonial in public advertising without separate permission.
You warrant that you have the rights necessary to submit your Content and that your Content does not unlawfully infringe another person’s intellectual property, privacy or other legal rights.
16. Prohibited conduct
You must not use the Service to:
- impersonate another person or create a false, misleading or duplicate account;
- use another person’s photographs without permission;
- harass, threaten, stalk, intimidate or abuse another person;
- engage in hate speech or unlawful discrimination;
- send unsolicited sexual or explicit material;
- share intimate material without consent;
- pressure or coerce another person into sexual activity;
- scam, defraud, blackmail, extort or financially exploit another person;
- request or solicit money as part of a scam or deceptive scheme;
- advertise, recruit or solicit business without permission;
- promote unlawful goods, services, weapons or controlled substances;
- disclose another member’s identity, address, profile, private messages or other private information without proper authority;
- publicly distribute screenshots or private profile material without permission or another lawful basis;
- upload malware or harmful code;
- scrape, harvest, index, copy or compile member information through automated means;
- use bots or automated systems to access the Service without written permission;
- bypass access, payment, moderation, verification or security controls;
- reverse-engineer or interfere with the Service except to the extent the law expressly permits; or
- encourage another person to breach these Terms.
Child Safety and Exploitation
Hey Bella is strictly for adults aged 18 years and over. We have zero tolerance for child sexual abuse, exploitation, grooming or child sexual abuse material.
Any account involved in such conduct will be immediately suspended or permanently terminated without notice. Hey Bella will preserve relevant information and report suspected unlawful conduct to appropriate law-enforcement, child-protection or regulatory authorities, where required or permitted by law.
17. Messages and administrative access
Messages sent through Hey Bella may be stored so they can be delivered and so we can operate safety, moderation, support and complaint processes.
Unless the Service expressly states otherwise, Hey Bella messages are not end-to-end encrypted.
Messages may be subject to proportionate automated or technical checks for spam, scams, fraud indicators, security threats and policy violations. Authorised Hey Bella personnel may access relevant messages where reasonably necessary to:
- investigate a report, suspected fraud, harassment or serious misconduct;
- respond to an immediate safety concern;
- investigate a technical or security incident;
- comply with law or a lawful request;
- enforce these Terms; or
- conduct limited, documented safety or compliance reviews.
Staff are not permitted to browse private messages for personal interest, entertainment, advertising or unrelated purposes.
18. Safety and interactions with members
You are responsible for deciding whether and how to communicate with or meet another member.
We recommend that members:
- use in-platform messaging initially;
- do not send money to another member;
- do not share banking credentials or unnecessary financial information;
- tell someone they trust before meeting a match;
- meet in a public place;
- arrange their own transport;
- leave an interaction if they feel unsafe; and
- use blocking and reporting tools where appropriate.
In Australia, call 000 where there is an immediate danger or emergency.
Hey Bella does not currently conduct criminal-record or other general background checks. Profile approval or selfie verification is not a guarantee that another member is trustworthy or safe.
Nothing in this section removes Hey Bella’s own non-excludable legal obligations.
19. Reports and moderation
Members may report suspected impersonation, scams, fraud, money requests, harassment, threats, stalking, underage use, hate speech, discrimination, unsolicited sexual content, non-consensual intimate content, violence, privacy violations or other breaches.
We may take reasonable and proportionate action including:
- reviewing relevant information;
- requesting an explanation;
- removing Content;
- restricting communications;
- warning a member;
- requiring reverification;
- temporarily suspending an account;
- permanently terminating an account;
- preserving evidence; or
- notifying police, emergency services, eSafety or another authority where required or reasonably necessary.
We may impose an interim restriction while investigating a matter. An interim restriction does not by itself mean a final conclusion has been reached.
20. Suspension and termination
Termination for Breach
Hey Bella reserves the right to suspend or terminate your membership, without prior notice, if you breach these Terms of Service. Where your membership is terminated as a result of your breach, you will forfeit any remaining membership period and will not be entitled to a refund or credit for any unused portion of your membership, except where required by applicable law.
You may close your account at any time.
We may reasonably suspend or terminate an application or account where:
- these Terms are materially or repeatedly breached;
- application or profile information is materially false or misleading;
- required verification cannot be completed;
- payment remains unpaid;
- we reasonably suspect fraud, impersonation, unlawful conduct or serious misuse;
- a credible safety risk exists;
- a member repeatedly receives substantiated serious reports;
- a person attempts to avoid a previous ban; or
- suspension or termination is required by law.
For serious, urgent or safety-related matters, we may act immediately without advance notice.
Otherwise, where reasonably practicable, we will provide notice, a general explanation and an opportunity to appeal. We may withhold details where disclosure could compromise another person’s safety or privacy, reveal confidential reporting or security controls, or prejudice an investigation.
After termination, future renewal will be cancelled and personal information will be handled under the Privacy Policy.
21. Appeals
You may request an internal review of an application decline, suspension or account termination by emailing support@joinheybella.com with Appeal in the subject line.
An appeal should normally be submitted within 14 days and should identify the decision, explain why you believe it should be reconsidered and provide relevant supporting information.
We aim to provide an appeal outcome within 30 days where reasonably practicable.
22. Hey Bella intellectual property
Hey Bella owns or licenses the intellectual property in the Service, including its branding, software, website design, databases, interfaces, text, graphics, moderation systems and proprietary selfie-verification and liveness technology.
These Terms do not transfer ownership of Hey Bella intellectual property to you.
You may use the Service only for personal, non-commercial dating purposes unless we expressly agree otherwise.
You must not reproduce, distribute, commercially exploit, copy or reverse-engineer Hey Bella intellectual property except where expressly authorised by us or permitted by law.
23. Privacy, cookies and analytics
Our Privacy Policy explains how we collect, use, disclose, store and protect personal information.
Hey Bella uses a site-wide cookie consent system. Essential technologies may be used where necessary for security, authentication, session management and core functionality. Non-essential analytics technologies, including Google Analytics 4 (GA4), are managed through the site-wide cookie consent controls as described in the Privacy Policy.
Where consent is required, you may accept, reject or later withdraw consent to non-essential cookies through the available cookie settings. Refusing non-essential cookies will not prevent access to core Service functionality, although some optional features or analytics-supported functionality may operate differently.
Further information about Hey Bella’s use of cookies and similar technologies is available in our Cookie Policy.
24. Third-party and infrastructure services
The Service may rely on third-party infrastructure, payment, delivery, analytics and security services, including providers such as Stripe, Amazon Web Services (AWS), Supabase, Cloudflare, Vercel, Fly.io, Resend, GitHub and Google Analytics.
Those providers may have separate terms and privacy practices for their independent activities. Hey Bella remains responsible for its own obligations and uses providers for defined operational purposes.
Availability of the Service may be affected by infrastructure or provider outages that are outside Hey Bella’s reasonable control.
25. Business sale, merger or restructuring
Hey Bella may transfer the operation of the Service, these Terms, business assets and associated rights and obligations as part of a genuine merger, acquisition, financing, restructuring, sale of the business or sale of relevant assets.
A successor or acquiring entity may receive member and applicant information as described in the Privacy Policy, subject to confidentiality, applicable privacy law and any non-excludable rights.
Where reasonably practicable and legally required, affected users will be notified of a material change in ownership or control and any materially different use of personal information.
26. Accessibility
Hey Bella aims to make the Service reasonably accessible to users with disabilities and to improve accessibility as the Service develops.
If you experience an accessibility barrier or require a reasonable alternative way to receive information or communicate with us, contact support@joinheybella.com. We will consider reasonable requests in light of the nature of the Service, available technology and applicable law.
Nothing in this section limits any accessibility or anti-discrimination right that cannot lawfully be excluded.
27. Availability and changes to the Service
We aim to provide a reliable Service but do not guarantee uninterrupted or error-free availability.
Access may be affected by maintenance, security incidents, infrastructure failures, provider outages, emergency moderation, legal requirements or events reasonably outside our control.
We may add, change or discontinue features. We will not materially reduce the core paid Service during a prepaid membership term without reasonable notice and an appropriate remedy where required by law.
If a material change substantially alters the Service a member purchased, we may provide a choice to continue, cancel or receive another appropriate remedy depending on the circumstances and applicable law.
28. Liability and non-excludable rights
Nothing in these Terms excludes or limits:
- rights and remedies under the Australian Consumer Law that cannot lawfully be excluded;
- liability that cannot lawfully be excluded or limited;
- liability for fraud or wilful misconduct; or
- another non-excludable statutory right.
To the extent permitted by law:
- Hey Bella does not guarantee another member’s conduct, statements or intentions;
- members remain responsible for their independent communications and meetings;
- Hey Bella is not responsible for another member’s independent off-platform conduct except to the extent Hey Bella caused or contributed to the relevant loss through its own breach, negligence or unlawful conduct; and
- Hey Bella is not responsible for loss that was not reasonably foreseeable in the circumstances.
Nothing in these Terms removes our obligation to provide services with the standard required by applicable law.
Indemnification
To the maximum extent permitted by law, you agree to indemnify Hey Bella Group against reasonable losses, liabilities, damages, claims, costs and expenses, including reasonable legal costs, arising directly from:
- your material breach of these Terms and Conditions;
- your unlawful, fraudulent or deliberately misleading use of the Service;
- Content you submit that unlawfully infringes another person’s rights; or
- your unlawful conduct toward another member or third party through the Service.
This indemnity does not apply to the extent that any loss, liability, damage, claim, cost or expense was caused or contributed to by Hey Bella’s own breach of law, negligence, fraud or wilful misconduct.
Nothing in this section excludes, restricts or modifies any right, guarantee or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.
29. Complaints and Mandatory Dispute Resolution
For a general complaint, contact support@joinheybella.com with Complaint in the subject line and provide enough information for us to understand the issue and the outcome you seek.
We aim to acknowledge complaints within seven business days and provide a substantive response within 30 days where reasonably practicable.
Mandatory Dispute Resolution and Mediation
Before commencing ordinary court proceedings, the parties must first make a genuine, good-faith attempt to resolve the dispute directly.
If the dispute is not resolved, the parties must participate in good-faith mediation before commencing court proceedings. Neither party may unreasonably refuse or delay mediation.
The parties should allow up to 30 days from written notice of the dispute for direct resolution and mediation to take place. If one party refuses or fails to participate in mediation within a reasonable period after receiving a written request to mediate, the other party will be regarded as having satisfied this requirement and may commence proceedings.
Nothing in this clause prevents either party from:
- seeking urgent or interim court relief;
- taking action necessary to preserve a limitation period or other legal deadline;
- making a complaint to a regulator, ombudsman, tribunal or law-enforcement authority; or
- exercising any right or remedy that cannot lawfully be excluded, restricted or delayed under the Australian Consumer Law or other applicable law.
30. Individual, class and representative proceedings
To the maximum extent permitted by applicable law, each party intends that a claim arising out of or relating to the Service or these Terms be brought in that party’s individual capacity rather than as a plaintiff, representative applicant or class member in a class, collective or representative proceeding.
This provision does not apply to the extent that an individual-proceedings requirement or class-action waiver would be unfair, void, prohibited or unenforceable under the Australian Consumer Law or another applicable law. It does not exclude or restrict any right or remedy that cannot lawfully be excluded, including any non-excludable right to commence, join or participate in representative proceedings.
If this section is held unenforceable in a particular matter, it will be read down or severed only to the extent necessary, and the remainder of these Terms will continue to apply.
31. Changes to these Terms
We may update these Terms to reflect changes in law, regulation, security, safety, providers, technology, features, pricing or reasonable operational requirements.
We will provide reasonable notice of a material change where required by law. A material change will not retrospectively remove accrued rights or impose a new charge for a prepaid period without an appropriate legal basis and any consent required by law.
Price changes are governed by Section 11.
Where a change requires new consent, we will request that consent rather than relying solely on continued use.
32. Ending the Service
Hey Bella may permanently discontinue all or part of the Service.
Where reasonably practicable, we will give affected paid members reasonable notice. If we permanently discontinue the core paid Service during a prepaid term, we will provide an appropriate remedy, which may include a pro-rata refund for the unused portion, subject to applicable law.
33. Electronic notices
We may send legal, renewal, account, safety and Service notices to the email address associated with your account or display notices within the Service.
You are responsible for maintaining a current email address and checking important communications from Hey Bella.
A cancellation, privacy request or complaint sent to the correct Hey Bella email address is not invalid merely because we have not yet opened or processed it.
34. General provisions
If any provision of these Terms is invalid, void or unenforceable, it will be read down or severed only to the extent necessary and the remaining provisions will continue to operate.
A delay or failure to enforce a right does not waive that right.
These Terms, together with the checkout disclosures and any policy expressly incorporated into them, form the agreement governing paid membership and use of the Service.
Nothing in these Terms creates a partnership, employment, agency or joint-venture relationship between you and Hey Bella.
35. Governing law
These Terms are governed by the laws of Victoria and the applicable laws of Australia.
Subject to any non-excludable right to bring a claim elsewhere, the courts and tribunals of Victoria have jurisdiction in relation to disputes concerning these Terms or the Service.
